Welcome to Rock Nerd. By using the Rock Nerd mobile app, website, or related services ("Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.
Rock Nerd provides a community-driven platform for rockhounding: discovering, sharing, and discussing rockhounding spots; identifying rocks and minerals; earning badges and levels; and connecting with other users (e.g., messaging, Rock Buddy matching). Some features are available only to paid premium subscribers.
You must be at least 13 years old to use the Services. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when registering and keep it up to date.
You agree to use the Services only for lawful purposes and in line with these Terms. You will not:
We may suspend or terminate your account and access if you violate these Terms or for other reasons we deem necessary to protect the community or the Services.
Premium features are offered through in-app subscriptions (and possibly one-time purchases) processed by Apple (App Store) or Google (Play Store). Payment, renewal, cancellation, and refunds are governed by the applicable store's terms. We do not control store billing. Subscription status is synced to your Rock Nerd account so we can grant premium access; we do not store your full payment details.
Free trial or promotional periods (e.g., 7-day free premium from a referral) may be offered at our discretion and are subject to the terms presented at signup.
You keep ownership of the content you submit (spots, comments, reviews, photos, messages). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content in connection with operating and promoting the Services. You represent that you have the right to grant this license and that your content does not violate any third-party rights or these Terms.
We may remove or refuse to display content that we believe violates these Terms or is harmful to the community, without prior notice where we consider it appropriate.
User-generated content. Spots, comments, reviews, and other user content are provided by users. We do not guarantee their accuracy, safety, or legality. Use locations and information at your own risk. Always respect private property, local laws, and safety guidelines.
No professional advice. Identification and other information in the app are for general interest only and do not constitute professional geological, legal, or safety advice.
Service "as is." The Services are provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, to the fullest extent permitted by law.
To the maximum extent permitted by law, Rock Nerd and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Services, including reliance on user-generated content or locations. Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred U.S. dollars if you have not paid us). Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.
You agree to indemnify and hold harmless Rock Nerd and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or any law.
You may stop using the Services at any time. We may suspend or terminate your account or access at any time, with or without cause or notice. Upon termination, your right to use the Services ceases. Sections that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification) will survive termination.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.
These Terms constitute the entire agreement between you and Rock Nerd regarding the Services. If any part of these Terms is held invalid or unenforceable, the remaining parts remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms are governed by the laws of the United States (and the State of Michigan to the extent applicable), without regard to conflict of law principles.
